Article 2. Quotes / Acceptance of Orders

All our quotes are obligation-free. We are only bound by an order once it has been confirmed in writing or once it has begun to be processed. Information related to products and prices, as well as the detailed order information, is compiled and distributed subject to changes and corrections.

Placing an order implies formal acceptance of these general conditions.

• Belgium Your order will be delivered within 1 to 2 working days after reception of payment.

• Neighbor countries Your order will be delivered within 4 to 6 working days after reception of payment.

• Other countries Your order will be delivered within 4 to 10 working days after reception of payment.

Liability for delay, loss or damage

• Delay during transport The delivery delays mentioned in Article 3 are indicative.
  Verba bvba shall not be liable for any delay occurred during transport.

• Loss
  In accordance with the legal framework regarding distance selling, Verba bvba remains responsible for the goods until delivery at destination. You will be informed of the sending date of your order. If you did not receive your order within 10 working days as from sending date you should notify us by mail or phone.

• Damage
  Verba bvba is responsible for safe and adequate packing. Upon reception of the package you should inspect the goods and inform us if any damage has occurred. You can do this by mail, preferably with a picture of the damaged item.  Do not throw away the postal packaging before inspecting the goods. Do not return any goods without advising us beforehand in written. Find more info on returning goods in article 5.

Article 4. Payment

Retail account

Online Payment

An online payment is secure and easy and without any extra cost for the customer. Your payment is registered immediately and your order will be handled immediately.

Bank transfer

If you prefer to pay by bank transfer, you are requested to pay the total amount of your invoice within 10 working days, mentioning your order number.

Your order will be sent upon reception of your payment on our account.

Wholesale account

Our deliveries are payable no later than 30 days after the date of invoice.

If the invoice is still unpaid on the due date then interest is charged ipso jure and without notice of default.
The unpaid invoice amount is increased by 10%, with a minimum of EUR 50,00, by way of an indemnity provision for extrajudicial collection charges and contractual damage, without prejudicing our right to other relevant collection charges.

Article 5. Complaints and returning of the goods

Customers have the right to inform the vendor of their wish to cancel the purchase, without justification and without penalty within 14 calendar days of delivery. In the event the costumer wishes to make recourse to this right, he/she is required to return all goods in original condition and packaging at his/her own risk and expense to Verba bvba – Rue Cardinal Mercier, 1 – 1460 Virginal – Samme - Belgium.

You should at all times advice us in written before returning any goods.

Goods that have been returned under the set conditions will be refunded within a delay of 10 working days.

Verba bvba reserves the right to refuse returned goods in case of suspicion of damage or wear caused by others than Verba bvba or our suppliers.

Our goods are checked before sending and will be adequately packed. You should check the goods immediately upon reception.

If you do notice any damage you should advice us in written. Do not throw away the postal packaging before checking the goods en do not return any goods before advising us beforehand in written.

Goods are returned to us at costumers charge and risk, except if goods were wrongly delivered or damaged.

Article 6.  Prices

Prices are in Euro, incl. 21% VAT, excl. delivery costs.

Professionals / Wholesale account

Prices are shown excl. VAT.

If you are an entrepreneur based in the EC then you are subject to the VAT intra community regulations. By filling out your VAT number on our Professional page you will see that you are exempted from VAT.

Artikel 7. Warranty

Our warranty is limited to the warranty for hidden faults and the warranty in the case of consumer purchases, as stipulated in the Civil Code.
We may only be held liable for damage in the event of deliberate act or gross negligence. We are not liable for any indirect damages whatsoever which may have been incurred by the Buyer.

Article 8. Property Rights

All delivered goods remain the property of the Vendor until paid for in full, including all costs and taxes, interest and fees. In the event of non-payment, we reserve the right to reclaim the goods by operation of law at the Buyer's expense.

All information on this site (logo’s, text, pictures,…) are property of Verba bvba or its suppliers. All reproduction or exploitation of it’s content is forbidden without prior written approval.

Article 9. Privacy

All orders from the internet site of Verba bvba (www.babease.be) imply the explicit permission of the Buyer to allow the processing and use of his/her personal information for such purposes as administration of a customer database, the management of orders, deliveries and invoices, solvency checks, marketing and advertising. The processing of such information for marketing purposes and individual advertising will only take place upon the Buyer's explicit declaration of agreement during the ordering process. Verba bvba will not be permitted to transfer this information to third parties. The Buyer has the right to view and correct all information. The Buyer also has the right at all times to oppose the processing of his/her personal information for direct marketing purposes and this without personal cost. For more information, the Buyer is invited to consult the public register held by the Privacy Protection Commission in Brussels.

Article 10 – Applicable law

All agreements concluded with the Vendor are subject to Belgian law. Any dispute generally arising in terms of the interpretation of the contract or its execution will be exclusively the jurisdiction of the courts in Nivelles under Belgian law.
